Wisconsin Supreme Court Justice David Prosser is “confident” his 7,300 vote margin of victory will stand despite a recount says one of Prosser’s representatives.

“This election was decided three weeks ago” says Brian J. Nemoir, President of Full Impact Communication.

The recount requested by his Prosser’s opponent Joanne Kloppenburg started Wednesday. Kloppenburg lost the election by a margin of less than .5 percent.

Kloppenburg Cuts Prosser Lead By 147 Votes On Day 1 of Wisconsin Recount

Day one of Wisconsin’s Supreme Court election recount yielded a steady stream of small gains for trailing candidate JoAnne Kloppenburg, but so far not at a rate that will vault her past David Prosser. Kloppenburg cut Prosser’s 7,316 vote lead to 7,169 votes…a gain of 147 for Kloppenburg. About 10.8% of the vote has been recounted. The UpTake’s recount spreadsheet.

The UpTake sent reporter Tracey Pollock to Waukesha County to observe the process. If you recall, Waukesha County Clerk Kathy Nickolaus failed to report 14,000 votes on election night, leading Kloppenburg to declare victory with a slim 200 vote margin. Once the ballots were included Prosser had a 7,000+ vote lead.

Because of that controversy, Nickolaus recused herself from duty on the recount. Instead, Judge Robert G. Mawdsley was appointed to oversee the recount in Waukesha County. Judge Mawdsley discusses the recount process and the progression thus far.

Wisconsin’s Government Accountability Board confirms that the JoAnn Kloppenburg campaign has asked for a recount in Wisconsin’s close Supreme Court race.

“The Government Accountability Board is prepared to move forward with a statewide recount of votes for Supreme Court Justice, as requested by the Kloppenburg campaign today. We have been preparing for a recount since Election Night. We have assembled an internal team to direct the recount, we have been in close consultation with our county clerk partners, and have arranged for legal representation by the Wisconsin Department of Justice. We anticipate the recount will begin the week of April 25, and plan to hold a teleconference meeting for county clerks on Monday afternoon.”

The election battle seen as a proxy between Wisconsin Governor Scott Walker and foes of his anti-union legislation may end or open a new chapter today.

Wisconsin Supreme Court candidate JoAnne Kloppenberg has until 5pm today to request a recount in her very close race with incumbent Supreme Court Justice David Prosser. While the margin is close enough for the state of Wisconsin to pay for the recount, Kloppenberg still has to decide if she wants to put herself through what could be several months of legal action and whether she and her supporters have enough money to pay the legal bills of the lawyers that will be needed in the fight. Legal fees for the 2009 US Senate recount in Minnesota ran close to $10 Million for each side and the principle lawyers from that fight have been retained by Kloppenberg and Prosser for this fight.

JoAnne Kloppenburg declares victory over David Prosser for Wisconsin Supreme Court Justice. According to the Associated Press, Kloppenburg has an unofficial lead of just over 200 votes after yesterday’s election.

Wisconsin Supreme Court candidate JoAnne Kloppenburg addressed her supporters at 12:30 a.m. this morning at the Edgewater Hotel in Madison, Wis.
Earlier today, Kloppenburg declared victory over incumbent Justice (and self-described fan of Governor Scott Walker) David Prosser after the Associated Press gave her a 204-vote lead. The total showed Kloppenburg with 740,090 votes and Prosser with 739,886. A recount is expected.

How A Recount Works In Wisconsin

Wisconsin’s Supreme Court election is apparently heading for a recount. Since The UpTake is your recount headquarters, we thought you’d want to know how a recount works in Wisconsin. The bottom line of all of this is canvassing must be complete before there is a recount, and it may take several days to complete the canvassing.

The source for this is a brief for the Wisconsin Legislative Council

A recount petition may be filed no earlier than the time of completion of the canvass and no later than 5:00 p.m. on the third business day following the last meeting day of the municipal or county board of canvassers determining the election for the office or referendum question or, if more than one board of canvassers makes a determination, no later than 5:00 p.m. on the third business day following the last meeting day of the board of canvassers which makes a determination. If the Board of State Canvassers makes the determination, the petitioner may file the petition no earlier than the last meeting day of the last county board of canvassers to make a statement in the election or referendum and no later than 5:00 p.m. on the third business day following the day on which the Elections Board receives the last statement from the county board of canvassers for the election or referendum. [s. 9.01 (1) (a), Stats.]

Wisconsin Voters Head to the Polls for Important Supreme Court Election

Wisconsin citizens headed to the polls this morning to vote in an important state Supreme Court election between progressive JoAnne Kloppenburg and conservative David Prosser. The outcome will be interpreted as a defeat, or a victory, for Wisconsin Governor Scott Walker, who gutted the state’s organized labor rights earlier this spring. Walker’s controversial legislation could be appealed all the way to the state Supreme Court.

Thousands March to Minnesota Capitol for the Middle Class

Several thousand citizens marched from Cathedral Park to the State Capitol in St. Paul, Minnesota, yesterday claiming, “We Are One!” in support of the middle class. This was one of over 1,000 rallies across the country. The date is significant. On April 4, 1968, Rev. Martin Luther King was shot dead in Memphis. He was there in support of sanitation workers fighting for their rights.

This rally brought together members from dozens of different unions plus the concerned citizenry. Several conservative Republican governors and legislators have tried to bust unions and demonize public employees. This effort has energized opposition from many quarters including almost all labor unions. The staggering response in Madison, Wis., a few weeks ago was the beginning of the expression of outrage to these attacks, thus the 1,000 plus marches on April 4. Many of the unions in addition to their marching banners were decked out with colored t-shirts. Teachers formed a large sea of blue shirts. The Teamsters produced their big red 18-wheeler truck.

It was a very emotional action. People are seriously concerned about basic living issues and see the proposed government actions as a threat their well being and quality of life.
